Esto es fácil de resolver. Simplemente coloque \thispagestyle{empty}o \thispagestyle{plain}antes del comando \tableofcontents. Es el texto del encabezado corriente el que se superpone al título, porque el encabezado es muy estrecho.
No me he molestado en repetir todo tu código, solo copié el fragmento donde tienes que ingresar el comando. Por supuesto, puedes hacer lo mismo de formas más sofisticadas.
Sin embargo, te recomiendo que, en lugar de todo el hackeo que le has hecho a la clase del libro, uses una clase comolibro de escrituradeScript KOMA, donde puedes realizar todos los cambios con los comandos integrados. Así evitarás todas las incompatibilidades que experimentarás.
Si prefieres la clase de libro original, te recomiendo que utilices un paquete de paquetes del mismo autor. el autor deenumitem,Javier Bezos López, también ha producido excelentes paquetes que cambian los estilos de página, encabezados y tablas de contenido.etc.. Mira estotítulos(control de estilo de página),títulossec(títulos de secciones alternativas) ytítulotoc(encabezados alternativos para toc/lof/lot). Y por último pero no menos importante,espacio de color, si prefieres que tus colores se impriman correctamente.
